JURISPRUDENCE (SCOPE ,NATURE AND IMPORTANCE )

 Jurisprudence  is one of the  oldest  branch of  social  science . Although  many  jurist  says  it is the  most oldest branch of  social  science. But still  it is the  matter of  discussion. 

There is  no  any definite  area, fixed area  of jurisprudence.  what is the matter of study under jurisprudence is  still vague. many Jurist  puts different  perspectives in this matter. 

study of jurisprudence  is not based on single matter or  subject. jurisprudence have different reginal views  which are different  with each; a. eastern  Jurisprudence b. western jurisprudence 

subject wise also it has different matter to  cover; a. criminal law b. property law  c. contract law d. constitutional law e. international law f. gender law g. human rights law i.e.

Thus  jurisprudence has wider perspective  to  study .  it is not  fair enough to know  jurisprudence  generally as  social science . 

When there was a practice of law to manage society and its aspects from that point the evolution, definition, differentiation of law  has been started. 

Roman legal system/law have been started before 2000 years,  in eastern society law has developed for 22/2500 year.   katuliya's arthasathra, yaghyaballhya, Narad smirti were founded from which eastern society are managed.  Before that we can  found Mesopotamian and Egyptians civilization that guides the society. At eastern society kirat's mundhum has advanced legal systems to guide society. Even we found the norms of international law and human rights law. 

There are different  perspectives on  study of law. eastern and western foundation of law have their own  feature so study of  jurisprudence should not need to be  guided by western philosophy. Eastern society with formation and modification of society it has developed different law to organize socity so  both philosophy need to be included while studying the jurisprudence. 

 Some jurist prefer the subject matter of jurisprudence should only be a 'law' while other jurist prefer to focus also on a  social, moral , behavior aspects as well. So, the scope of jurisprudence is still matter of discussion...
